David F. Barton has extensive litigation experience concentrating his practice in environmental, administrative, government and government contracts law. He joined Gardner Law in 1996 after serving as a United States Air Force JAG officer, as well as having six years of private practice with a Texas firm. Mr. Barton successfully prosecuted the landmark case of Rothe Development Corp. v. The United States, 545 F.3d 1023 (Fed. Cir. 2008), finding, as unconstitutional, a Department of Defense procurement minority preference program.
Mr. Barton counsels clients in environmental matters, government contracts, regulatory compliance, commercial law, and litigation related to those areas. He represents industries, businesses, and government units on matters involving water, air, solid and hazardous waste, toxins, wetlands, endangered species, historic preservation, NEPA, Superfund and federal and state court litigation in those areas.
